Under IC 4-22-2-24, notice is hereby given that on June 16, 2009, at 1:00 p.m., at the Indiana Gaming Commission, 101 West Washington Street, Suite 1600, East Tower, Executive Conference Room, Indianapolis, Indiana, the Indiana Gaming Commission will hold a public hearing on a proposed rule regarding gaming device and equipment testing.
The Commission has the authority under IC 4-33-4-2, IC 4-33-4-3, IC 4-35-4-2, and IC 4-35-4-3 to promulgate rules regarding the conduct and integrity of gaming in Indiana casinos. The proposed rule amends 68 IAC 2-6-2 to replace the term "riverboat" with "casino", eliminate obsolete "token acceptors" as requiring testing, and establish clearer guidelines for casino and supplier licensees to follow regarding testing of any gaming devices or equipment; amends 68 IAC 2-6-3 to authorize multiple independent gaming laboratories and establish guidelines for persons who submit gaming devices or equipment to an independent laboratory; and repeals 68 IAC 2-6-15 to eliminate requirements for obsolete equipment. The proposed rule would require 13 regulated entities, that is, casino licensees, to play a more active role in the process of testing gaming devices and equipment, which may result in minimal increased costs to the casinos for personnel training and time costs of adjusting to the casinos' new responsibilities. As a result of the requirements that the proposed rule imposes, the Commission will be able to more efficiently monitor and restrict information flow from the test labs to the Commission, thus improving government efficiency. This rule will also more clearly articulate the standards and procedures for submission of gaming equipment to test labs, saving an estimated six and one-half to eight man-hours per week now used to process irrelevant gaming equipment. The Commission relied on internal analysis in determining that the imposition of requirements is necessary.
