Under IC 4-22-2-24, notice is hereby given that on May 20, 2009, at 1:00 p.m., at the Indiana Gaming Commission, 101 West Washington Street, Suite 1600-East Tower, Indianapolis, Indiana, the Indiana Gaming Commission will hold a public hearing on new proposed rules regarding patron counting systems and standards.

The Indiana Gaming Commission has the authority to promulgate rules in accordance with the requirements of IC 4-33. The proposed rule amends 68 IAC 2-7 and 68 IAC 15 regarding patron counting systems. Specifically, the proposed rule identifies patron counting systems as "associated equipment", establishes standards for tracking patron ingress and egress on riverboats, outlines the process for approval and testing of patron counting systems, establishes requirements for secondary backup systems, and removes outdated provisions. The proposed rule also adds terms regarding deviations of rule provisions. The proposed rule imposes no requirements or costs on small businesses but may potentially affect state revenue. Costs and requirements on other regulated entities are justified by the state's interest in accurately assessing admission taxes, as required by IC 4-33. Any data, studies, or analyses relied upon in determining the imposition of costs or requirements may be inspected or copied at the office of the Indiana Gaming Commission.
