IC 4-22-2.1-5 Statement Concerning Rules Affecting Small Businesses
The Indiana Emergency Medical Services Commission is proposing to amend its regulations in LSA Document #08-879 (copy attached) to amend its rules at 836 IAC 1-1-5 to revise the required data elements to conform to specific National Emergency Medical Service Information System data elements and to correct typographical errors.

Estimated Number of Small Businesses Subject to this Rule:
The Commission estimates that approximately 122 small businesses will be subject to this rule. The Commission estimates that of those businesses, three will incur a fiscal impact as a result of the new rule.

Estimated Average Annual Administrative Costs That Small Businesses Will Incur:
The Commission estimates that none of the small businesses will incur any administrative expenses resulting from the proposed rule. Data is being provided to the Emergency Medical Services Commission now, under its existing rules, and the change and increase in the number of categories will have only a de minimis administrative cost.

Estimated Total Annual Economic Impact on Small Businesses:
The Commission estimates that the economic impact on small businesses as a result of compliance with this rule will total $12,500. Two small businesses will have a one-time cost increase of $2,500 each (total of $5,000) and one small business will have a one-time cost increase of $5,000. These costs are a result of fees charged by the small businesses existing software providers to change to the new data elements.

Supporting Data, Studies, and Analyses:
The Commission staff conducted two surveys to determine how many of the entities affected by the new reporting data elements are small businesses and how many of them would incur a cost to comply.

Regulatory Flexibility Analysis of Alternative Methods:
In view of the very small fiscal impact (three small businesses out of a total of 122, less than 2.5%), there is no more flexible way to achieve the objectives of the rule change.

Explanation of Preliminary Determination:
The Commission determined that achieving consistency with a national reporting system would make review of vehicular accident injuries and deaths in Indiana, and the efficacy of the emergency medical services system in Indiana, more accurate and provide greater detail to permit short and long-term improvements to be designed more effectively.
