Under IC 4-22-2-24, notice is hereby given that on April, 15, 2009, at 10:25 a.m., at the Indiana Professional Licensing Agency, Indiana Government Center South, 402 West Washington Street, Room W064, Indianapolis, Indiana, the Indiana Auctioneer Commission will hold a public hearing on proposed amendments concerning continuing education requirements to revise the number of continuing education hours and elective hours for renewal to bring the requirements into conformity with statutory changes, to modify the requirements for certificate of completion, to allow instruction for an approved distance learning education course to be more than eight hours of instruction in one day, and proposed new rules concerning establishing distance learning continuing education requirements and procedures for auctioneers and establishing the requirements and procedures for the approval of distance learning continuing education course sponsors.
The Indiana Auctioneer Commission has the authority to promulgate rules in accordance with IC 4-22-2 to enforce and administer IC 25-6.1, including establishing the requirements for continuing education. This rule change is mandated by IC 25-1-4-3.2, which requires that "(a) board or agency regulating a profession or occupation under this title (25)...shall require that at least one-half (50%) of all continuing education requirements must be allowed by distance learning methods...". The proposed rule also updates the Commission's rules to reflect that the licensure period is four years and that each licensee is required to obtain 16 hours of continuing education to renew. The proposed rule also clarifies and revises language to make the rules consistent with the Commission's statutes, removes out-of-date and unnecessary language in the rules, and revises the continuing education requirements for licensees and providers to bring the rules into conformity with the Commission's statutes. This proposed rule will have no cost on the regulated entities. The providers have another avenue to provide services to licensees to generate revenue, and the licensees will have more opportunities to obtain continuing education without taking time from their work.
Copies of these rules are now on file at the Indiana Government Center South, 402 West Washington Street, Room W072 and Legislative Services Agency, One North Capitol, Suite 325, Indianapolis, Indiana and are open for public inspection.
