Under IC 4-22-2-24, notice is hereby given that on January 16, 2009, at 1:30 p.m., at the Indiana Government Center North, 100 North Senate Avenue, Room N501, Indianapolis, Indiana, the Office of Environmental Adjudication will hold a public hearing on the proposed amendments to 315 IAC 1, which establishes procedural rules for the Office of Environmental Adjudication to provide for the consolidation of proceedings with the Natural Resources Commission, Division of Hearings, as required by SEA 134.

The rule is being jointly adopted by the Natural Resources Commission (Division of Hearings) and the Office of Environmental Adjudication to comply with P.L.84-2008, and particularly with IC 14-10-2-2.5. P.L.84 provides litigants with an opportunity to seek consolidation of proceedings, pending before these adjudicatory agencies, where there are common questions of water quantity or water quality. IC 14-10-2-2.5(d) requires the Natural Resources Commission and the Office of Environmental Adjudication to adopt joint rules to implement this section.

The proposed rule amendments would not impose requirements or costs under IC 4-22-2-24(d)(3).
