IC 4-22-2.1-5 Statement Concerning Rules Affecting Small Businesses
Estimated Number of Small Businesses Subject to this Rule:
The rule implements P.L.84-2008. The legislation provides an opportunity for parties to adjudications, pending before the Office of Environmental Adjudication and the Natural Resources Commission (Division of Hearings), to consolidate proceedings pertaining to water quality or water quantity. Although what is sometimes called "overlapping jurisdiction" between these agencies (effectively, between Indiana Department of Environmental Management and the Department of Natural Resources) is uncommon, in any such adjudication where a small business is a party, the small business could be subject to the rule.
