Under IC 4-22-2-24, notice is hereby given that on January 16, 2009, at 1:30 p.m., in the Indiana Government Center North, 100 North Senate Avenue, Room N501, Indianapolis, Indiana, the Natural Resources Commission will hold a public hearing on proposed amendments to 312 IAC 3-1, which establishes procedural rules for the Natural Resources Commission, Division of Hearings, to provide for the consolidation of proceedings with the office of environmental adjudication as required by SEA 134.
The rule is being jointly adopted by the Natural Resources Commission (Division of Hearings) and the Office of Environmental Adjudication to comply with P.L.84-2008, and particularly with IC 14-10-2-2.5. P.L.84 provides litigants with an opportunity to seek consolidation of proceedings, pending before these adjudicatory agencies, where there are common questions of water quantity or water quality. IC 14-10-2-2.5(d) requires the Natural Resources Commission and the Office of Environmental Adjudication to adopt joint rules to implement this section.
The proposed rule amendments would not impose requirements or costs under IC 4-22-2-24(d)(3).
Copies of these rules are now on file at the Natural Resources Commission, Division of Hearings, Indiana Government Center North, 100 North Senate Avenue, Room N501 and Legislative Services Agency, One North Capitol, Suite 325, Indianapolis, Indiana and are open for public inspection.
