Under IC 4-22-2-24, notice is hereby given that on December 16, 2008 at 10:30 a.m., at the Indiana Government Center South, 302 West Washington Street, Room E114, Indianapolis, Indiana, the Alcohol and Tobacco Commission will hold a public hearing on a proposed new rule to add 905 IAC 1-53 concerning type II gaming permits.
House Enrolled Act 1153 authorizes type II gaming for taverns that are issued a retailer's endorsement by the Alcohol and Tobacco Commission (ATC). The proposed rule addresses the establishment, implementation, and operation of type II games to ensure that the type II gaming operations are consistently operated in a fair and honest manner. The proposed rule imposes minimal costs on businesses. The portions of the rule pertaining to the manufacture of type II games are based on well accepted industry practices that are already in use. The portions of the rule pertaining to the conduct of type II games by retailers require the retailer to incur negligible costs to post notices pertaining to the games for sale and the corresponding odds of winning the games. The rule's record keeping requirements impose little additional cost than that already imposed by the Act itself, which requires retailers to maintain records of type II games in a manner that is convenient to the ATC.
Copies of these rules are now on file at the Indiana Government Center South, 302 West Washington Street, Room E114 and Legislative Services Agency, One North Capitol, Suite 325, Indianapolis, Indiana and are open for public inspection.
