Under IC 4-22-2-24, notice is hereby given that on December 12, 2008, at 1:00 p.m., at the Indiana Gaming Commission, 101 West Washington Street, Suite 1600, East Tower, Indianapolis, Indiana, the Indiana Gaming Commission will hold a public hearing on new proposed rules regarding the conduct of charity gaming related activities by qualified organizations.
The Indiana Gaming Commission has the authority to promulgate rules in accordance with the requirements of IC 4-32.2. The proposed rule amends 68 IAC 21 concerning the conduct of charity gaming activities by qualified organizations licensed by the Indiana Gaming Commission. The proposed rule amends provisions regarding oversight of euchre events, requires organizations to maintain identifying information regarding flare card winners winning more than $50, requires organizations changing the location of its annual bingo or annual charity game night licenses to publish notice in the appropriate newspaper, introduces a prohibition against conducting allowable events in a bar or tavern, or a facility attached to a bar or tavern, which is not owned by a qualified organization, and establishes provisions regarding refunds and fees for amendments to licenses. The proposed rule also updates the existing rule to reflect changes made during the most recent legislative session. In addition, the rule makes administrative, ministerial, and technical changes. The proposed rule will increase the cost on regulated entities by establishing an amendment fee for changes to charity gaming licenses. The proposed rule also results in increased costs for those organizations conducting a winner take all drawing insofar as it requires those organizations to maintain a ledger in which the organization collects and records information regarding winners and prizes awarded. The Commission has relied on data gathered from qualified organizations in its determination regarding the imposition of requirements and costs.
