Under IC 4-22-2-24, notice is hereby given that on October 2, 2008, at 10:00 a.m., at the Indiana Professional Licensing Agency, Indiana Government Center South, 402 West Washington Street, Room W064, Indianapolis, Indiana, the Indiana State Board of Health Facility Administrators will hold a public hearing to amend 840 IAC 1 and 840 IAC 2 to implement rule changes based on P.L.54-2007, including establishing criteria for licensure as a residential care facility administrator and to establish separate education, experience, and training requirements for licensure as a residential care facility administrator and comprehensive health care facility administrator.
The intent of P.L.54-2007 was to provide a larger pool of candidates for hire as administrators of residential care facilities. All licensed long-term care facilities are required by law to have a licensed administrator over the facility. Under the prior statute, the Board only issued licenses to health facility administrators who could then operate either a comprehensive care facility or a residential care facility. Residential care facilities found it increasingly difficult to find licensed administrators that would work for a lower salary than what a comprehensive care facility could pay. Under the new statute, residential care facilities may employ an administrator that holds a residential care administrator license, which requires a shorter administrator-in-training program. The proposed rule provides these standards and also clarifies and revises language and removes out-of-date and unnecessary language in the rules. No fees are being increased under the proposed rules. The proposed rule changes will impose costs on small businesses under IC 4-22-2.1-5; however, this change will result in an insignificant fiscal impact on the regulated entities.
