Notice of Public Hearing

Under IC 4-22-2-24, notice is hereby given that on September 16, 2008, at 2:00 p.m., at the Indiana Gaming Commission, 101 West Washington Street, Suite 1600-East Tower, Indianapolis, Indiana, the Indiana Gaming Commission will hold a public hearing on a new proposed rule adding casino-related definitions; modernizing definitions of "institutional investor", "key person", and "substantial owner"; removing the requirement that the executive director approve a progressive jackpot before a casino utilizes a progressive jackpot; revising the exclusion list process; specifying the procedure for removal from the exclusion list; conforming seizure, forfeiture, and disciplinary process to the Administrative Orders and Procedures Act; adding civil fine procedures for gaming violations; and making numerous technical changes.
The Indiana Gaming Commission has the authority to promulgate rules in accordance with the requirements of IC 4-33 and IC 4-35. With one exception, it is estimated that zero small businesses in the gaming industry will be affected by this rule. Casino companies may need to invest some educational time and cost to educate staff about changes in patron exclusion procedures, but none of the casino companies are small businesses according to IC 4-22-2.1-4. The exception is that a new civil fine procedure could impose costs upon small businesses that are supplier licensees if a supplier licensee violates a gaming law or regulation. The civil fine would only affect the few small businesses that are supplier licensees.
Copies of these rules are now on file at the Indiana Gaming Commission, 101 West Washington Street, Suite 1600-East Tower and Legislative Services Agency, One North Capitol, Suite 325, Indianapolis, Indiana and are open for public inspection.
