Notice of Public Hearing
Under
IC 4-22-2-24, notice is hereby given that on September 2, 2008, at 10:30 a.m. EDT, at the Indiana Government Center South, 302 West Washington Street, Room E114, Indianapolis, Indiana, the Alcohol and Tobacco Commission will hold a public hearing on a proposed rule to add
905 IAC 1-43.1 concerning gaming site permits.
This proposed rule reclassifies existing riverboat and adjacent landsite permits to gaming site permits. In addition to existing holders of riverboat and adjacent landsite permits, Public Law 233-2007 authorized the Alcohol and Tobacco Commission to issue gaming site permits to holders of a gambling game license issued under
IC 4-35. The proposed rule addresses issuance, scope, fee, expiration, and administrative penalties of gaming site permits. The proposed rule mirrors the existing rule in many respects since the Alcohol and Tobacco Commission made every effort to minimize impact on existing permit holders. The proposed rule merely attempts to effectuate reassignment of existing riverboat and adjacent landsite permits to gaming site permits and allow for issuance of gaming site permits to holders of gambling game licenses issued under
IC 4-35. The proposed rule updates state regulations to conform to current industry practices of the regulated entities. The proposed rule does not impose any costs not already required under state regulations and may reduce administrative costs for the Alcohol and Tobacco Commission as well as the regulated entities. The proposed rule minimizes administrative burden while enhancing privileges and the ability to expand business operation so long as the support facilities are in close proximity to the gambling operation.
