IC 4-22-2.1-5 Statement Concerning Rules Affecting Small Businesses
Based on analysis of the corporate structure and financial information of casino licensees, horse racing permit holders, and supplier licensees, the Indiana Gaming Commission staff predicts that zero small businesses could be affected by this rulemaking. The rule is a rewrite of an existing rule that defines what constitutes a "slot machine" and as such will impact the slot machine suppliers (who manufacture or distribute, or both, the machines) and the casino operators (who will be required to interpret and comply with the proposed rule to ensure that their machines fit the meaning of whichever term is relevant to their gambling operations). No Commission-licensed slot machine suppliers or casino operators are "small businesses" according to IC 4-22-2.1-4.
Commission staff estimates $0 total annual economic impact that compliance will have on small businesses subject to the rule.
No less intrusive or less costly alternative would achieve the purpose of this proposed rule, especially considering the estimated $0 impact on small businesses.
Commission staff relied upon a search of the corporate information for all supplier and casino licensees and internal analysis that the rule would only impact slot machine and electronic gaming device manufacturers/distributors and casino operators in reaching the conclusions contained in this statement.
