RE: Notification of noncompliance with 60-day requirement


Dear Representative Pelath:

Pursuant to Indiana Code § 4-22-2-19(c), please consider this letter notification of the Indiana Library and Historical Board's (Board) noncompliance with the 60-day provision of Indiana Code § 4-22-2-19. The Board did not begin the rulemaking process to repeal 590 IAC 4 and adopt 590 IAC 5 regarding the certification of librarians within 60 days after the statutory authorization.

The Board initially intended to readopt 590 IAC 4, which was due to sunset at the end of 2007. After several months of certification task force meetings, it was determined that the changes would be so major that it would be more effective to write and adopt a totally new rule than to revise the then current rule. At that time, it seemed reasonable to allow 590 IAC [sic, to] expire at the end of 2007 and adopt a totally revised rule in 2008.
