IC 4-22-2.1-5 Statement Concerning Rules Affecting Small Businesses
LSA Document #07-310 adds 868 IAC 1.1-3-8 to establish requirements for limited scope temporary psychology permits. In 2006, P.L.157-2006, SECTION 69 provided the State Psychology Board with the discretionary authority to adopt rules establishing requirements for limited scope temporary permits. The statutory language is found in IC 25-33-1-4.5.
The proposed rule implements the statute by setting application and reporting requirements.

Impact on Small Businesses
1. Estimate of the number of small businesses, classified by industry sector, that will be subject to the proposed rule.

The State Psychology Board anticipates that there will be approximately five applications filed for limited scope psychologist temporary permits per year.

2. Estimate of the average annual reporting, record keeping, and other administrative costs that small business will incur to comply with the proposed rule.
The application fee for a limited scope temporary permit will be $50. The fee is the same as that which is charged for a temporary permit for practice pending full licensure.
This rule will not impose any adverse economic impact on small businesses. The reporting requirements are limited to individual holders of the limited scope permit who would be required to file an application and report to the board on a one-time basis where they practiced within the state during the two-year period of the limited license's validity. There are no other reporting, record keeping, or compliance requirements on small businesses.

3. Estimate of the total annual economic impact that compliance with the proposed rule will have on all small businesses subject to the rule.
This rule has an insignificant fiscal impact. The application fee for a limited scope permit is $50. In 2007, the Medical Licensing Board of Indiana issued 29 limited scope medical permits. There are 24,317 holders of Indiana medical licenses. By way of comparison, there is a total of 1,612 holders of Indiana psychologist licenses. The board anticipates that there will be approximately five applications filed for limited scope psychologist temporary permits per year.

4. Statement justifying any requirement or cost that is imposed on small businesses by the rule; or any other state or federal law.
The cost is minimal. The reporting requirements are limited to individual holders of the limited scope permit who would be required to file an application and report to the board on a one-time basis where they practiced within the state during the two-year period of the limited license's validity. It is anticipated that the report would take not more than 15 minutes to prepare.

5. Regulatory flexibility analysis
No alternatives were considered as the proposed rule has an insignificant fiscal impact.

6. Conclusion
Frequently in forensic evaluations, a psychologist who is nationally regarded as an expert is asked to evaluate clients and testify in court cases within Indiana. Under the prior law, only Indiana licensed psychologists with an endorsement as a health service provider in psychology were permitted to evaluate clients in Indiana. The proposed rule implements the new statute so that psychologists who only need to practice in Indiana on a short-term basis do not have to apply for a full license.
