Notice of Public Hearing
Under
IC 4-22-2-24, notice is hereby given that on June 26, 2008, at 8:45 a.m., at the Indiana Professional Licensing Agency, Indiana Government Center-South, 402 West Washington Street, Room W064, Indianapolis, Indiana, the Medical Licensing Board of Indiana (Board) will hold a public hearing to repeal
844 IAC 10-4-3 concerning reinstatement of delinquent certificate.
The current rule requires a renewal applicant to take and pass an examination if the certificate has been expired for more than three years. This rule can result in the unintended consequence of requiring a former Indiana licensee who is licensed and in good standing in another state being required to take the national licensing examination should the licensee decide to return to Indiana to practice.
IC 25-1-8-6 has been amended over time so that it provides the Board and the Occupational Therapy Committee with the necessary authority to require remediation of practitioners seeking reinstatement if needed. This rule will not impose any adverse economic impact on small businesses nor require new reporting or record keeping requirements.
