SECTION 1. 410 IAC 15.1 IS ADDED TO READ AS FOLLOWS:

ARTICLE 15.1. MOBILE HEALTH CARE ENTITY


Rule 1. Mobile Health Care Entity Registration


410 IAC 15.1-1-1 "Department" defined

Sec. 1. As used in this article, "department" means the Indiana state department of health.

410 IAC 15.1-1-2 "Health care entity" defined

Sec. 2. As used in this article, "health care entity" means an entity that:
(1) is registered or licensed as a health care entity under the laws of:
(A) another state;
(B) a foreign country; or
(C) a province of a foreign country; and
(2) provides health care services, including the performance of health care tests, in a mobile facility or temporary location for a short period of time.

Sec. 3. A health care entity may not provide services in Indiana until the health care entity is registered with the department.

410 IAC 15.1-1-4 Registration

Sec. 4. (a) To register, a health care entity shall submit a completed application to the department.

(b) A health care entity must disclose the following information on the department prescribed application:
(1) The types of health care services that the health care entity will provide in Indiana.
(2) The names of any employees, who are currently in good standing, licensed, certified, or registered in a health care profession in:
(A) Indiana; or
(B) any other state;
and a copy of the employee's license, certification, or registration.
(3) Any health care services that are to be provided under a contract between the health care entity and a person that is licensed, certified, or registered in Indiana to provide health care services.
(4) The types of:
(A) health care services;
(B) health care tests; and
(C) equipment;
that the health care entity will perform or use.
(5) The manner in which test results and recommendations for health care based on the results are disclosed to the patient.
(6) The:
(A) health care entity's:
(i) name;
(ii) address; and
(iii) telephone number; and
(B) name of any company that is affiliated with the health care entity.
(7) The name and address of the:
(A) state agency;
(B) foreign country agency; or
(C) province agency of a foreign country agency;
where the health care entity is registered or licensed.

(c) A health care entity that submits a completed application and meets the requirements of IC 16-41-42 and this rule will be issued a certificate of registration.

410 IAC 15.1-1-5 Certificate of registration

Sec. 5. (a) A registered health care entity shall display the entity's certificate of registration in a conspicuous place in sight of a consumer of the health care entity.

(b) The certificate of registration expires one (1) calendar year after its issuance.

410 IAC 15.1-1-6 Renewal of registration

Sec. 6. (a) A registered health care entity shall submit a department prescribed application for renewal of its registration.

(b) A health care entity may not provide services if their registration is expired.

410 IAC 15.1-1-7 Compliance with laws

Sec. 7. Registration of a health care entity under this rule does not exempt a health care:
(1) professional from the:
(A) licensure;
(B) certification; and
(C) registration;
requirements of IC 25; or
(2) service from applicable requirements of IC 16 or IC 25.
