Under IC 4-22-2-24, notice is hereby given that on May 22, 2008, at 8:30 a.m., at the Indiana Professional Licensing Agency, Indiana Government Center-South, 402 West Washington Street, Room W064, Indianapolis, Indiana, the Medical Licensing Board of Indiana will hold a public hearing on proposed amendments to 844 IAC 2.2 to implement 2007 legislative changes to IC 25-27.5 regarding requirements for prescriptive authority for qualified licensed physician assistants, to make other nonsubstantive changes to 844 IAC 2.2 by updating rule language and clarifying requirements, to amend 844 IAC 2.2-1 to add definitions relating to anesthesia under IC 25-27.5-5-4(f), to amend 844 IAC 2.2-2 to add fee requirements for both prescriptive authority and controlled substance registration applications, and to repeal 844 IAC 2.2-1.
The proposed rule is necessary to update current language based upon the legislation enacted in 2007. The Physician Assistant Committee began granting prescriptive authority to qualified, licensed physician assistants July 1, 2007. Subsequently the Committee began studying the process and met with interested parties regarding the proposed rule and how to enhance 844 IAC 2.2. The study consisted of the review of approximately 200 applicants that applied for and received prescriptive authority. Issues surrounding the supervisory agreement and other statutory requirements were identified and addressed in the proposed rule. The proposed rule includes the cost of the application fee for prescriptive authority and the controlled substance registration. Both fees are required to offset the additional administrative costs associated with issuing prescriptive authority to physician assistants. The rule also addresses minor technical changes such as removing "certification" and replacing the term with "licensure" as dictated by the 2007 legislation. The legislation also required the rule to include definitions relating to anesthesia.
Copies of these rules are now on file at the Indiana Government Center-South, 402 West Washington Street, Room W072 and Legislative Services Agency, One North Capitol, Suite 325, Indianapolis, Indiana and are open for public inspection.
