TITLE 312 NATURAL RESOURCES COMMISSION

Emergency Rule

DIGEST

Temporarily amends 312 IAC 5-7-14, which governs the operation of watercraft on the Tippecanoe River in White County and Carroll County, including Lake Shafer and Lake Freeman, to establish a 10 mile-per-hour speed limit on the portions of Lake Shafer or its tributaries where dredging operations are scheduled during the next 12 months. Effective March 1, 2008.

SECTION 1. A person must not operate a watercraft in excess of ten (10) miles an hour on Lake Shafer or its tributaries in White County at any of the following locations:

(1) A part of the southwest quarter of section 15, a part of section 16, and a part of the northeast quarter of section 21, township 27 north, range 3 west and running from a line formed by the point of intersection of the south shoreline or water line of Lake Shafer and the west line of section 16 and the point of intersection of the east shoreline or water line of Lake Share and the south line of section 9; thence southeast to a line running across the lake and being parallel to and five hundred (500) feet above Norway Dam.

(2) A part of section 32, township 28 north, range 3 west from a point one thousand (1,000) feet north of Lowe's Bridge at County Road 550 North, then southwesterly a distance of three thousand (3,000) feet to a point two thousand (2,000) feet southwest of Lowe's Bridge, all within Liberty Township.

(3) A part of the southwest quarter of section 32, township 28 north, range 3 west and a part of the northwest quarter of section 5, township 27 north, range 3 west from a point two thousand (2,000) feet south of Lowe's Bridge south three thousand three hundred (3,300) feet to the south line of the north half of the northwest quarter of section 5 extended across Lake Shafer near the south side of the Big Monon Bridge over West Shafer Drive.

(4) A part of the west half of section 5, township 27 north, range 3 west from the south line of the north half of the northwest quarter of section 5 extended across Lake Shafer near the south side of the Big Monon Bridge over West Shafer Drive, then south approximately two thousand six hundred fifty (2,650) feet to the north line of the south half of the southwest quarter of section 5.

(5) A part of the southwest quarter of the southwest quarter of section 5, a part of the southeast quarter of section 6, a part of the northeast quarter of the northeast quarter of section 7, and a part of the northwest quarter of section 8 in township 27 north and range 3 west. This part is described as being from the north line of the south half of the southwest quarter of section 5, then south and southeasterly two thousand one hundred (2,100) feet to a line formed by the point of intersection of the west shoreline or water line of Lake Shafer and the south line of the north half of the northwest quarter of section 7 (being County Road 375 North extended east) and also being the south line of the north quarter of the northwest quarter of section 8, and the point of intersection of the east shoreline or water line of Lake Shafer and the north line of section 8.

(6) A part of the north half of section 8, township 27 north, range 3 west beginning at a line formed by the point of intersection of the west bank of Lake Shafer and the south line of the north half of the northeast quarter of section 7 (being County Road 375 North extended east) and also being the south line of the north half of the northwest quarter of section 8, and the point of intersection with the east shoreline or water line of Lake Shafer and the north line of section 8, then southeasterly three thousand seven hundred (3,700) feet to the west line of the east half of the northeast quarter of section 8.

(7) A part of the east half of section 8 and a part of the west half of section 9, township 27 north, range 3 west from the west line of the east half of the northeast quarter of section 8, then southeasterly two thousand two hundred fifty (2,250) feet to the north line of the south half of the southwest quarter of section 9 extended across Lake Shafer and being at the north edge of the Isle of Homes area.

(8) A part of the southeast quarter of section 8, a part of the southwest quarter of section 9, a part of the northeast quarter of section 17, and a part of the northwest quarter of section 16 in township 27 north, range 3 west. This part is described as being from the north line of the south half of the southwest quarter of section 9 extended across Lake Shafer and being at the north edge of the Isle of Homes area, then southerly and southeasterly three thousand (3,000) feet to a line formed by the point of intersection of the south shoreline or water line of Lake Shafer and the west line of section 16 and the point of intersection of the east shoreline or water line of Lake Shafer and the south line of section 9.

SECTION 2. The restrictions set forth in SECTION 1 of this document are in addition to those set forth at 312 IAC 5-7-14.

SECTION 3. SECTIONS 1 and 2 of this document expire on February 28, 2009.
