IC 4-22-2.1-5 Statement Concerning Rules Affecting Small Businesses
Estimated Number of Small Businesses Subject to this Rule
The Natural Resources Commission estimates that no small businesses would be directly affected by proposed 312 IAC 11-3-4. The rule adoption is in response to a 2006 directive by the Indiana General Assembly that a requirement for common use of structures on public freshwater lakes, where necessary to accommodate the interests of landowners having property rights abutting a lake or rights to access a lake, be set out by rule. The rule would be consistent with traditional agency practice. A review of the Commission's records as to when this issue has arisen did not identify an instance involving a small business. Most typically, the issue has arisen where multiple off-lake residences had a common easement to access the lake, but the easement did not provide sufficient lake frontage for each residence to place an individual pier.

The Commission estimates that there will be no administrative costs to small businesses as a result of compliance with this rule.

Regulatory Flexibility Analysis of Alternative Methods
The Commission does not propose an alternative regulatory method since the proposal has no impact on small businesses. The Commission did not rely on studies in its decision not to employ alternatives to the proposed rule.
