Notice of Public Hearing

Under IC 4-22-2-24, notice is hereby given that on September 27, 2007, at 11:00 a.m., at the Indiana Government Center-South, 402 West Washington Street, Room W064, Indianapolis, Indiana, the Medical Licensing Board of Indiana will hold a public hearing on proposed amendments concerning the establishment of standards for procedures performed in office-based settings that require moderate sedation/analgesia, deep sedation/analgesia, general anesthesia, or regional anesthesia.
The Medical Licensing Board of Indiana is mandated to promulgate rules in accordance with IC 25-22.5-2-7 establishing standards for office-based procedures that require moderate sedation, deep sedation, or general anesthesia. The proposed rule addresses a state requirement and a significant market failure. The rule will serve a public need by promoting public safety. The rule will require all physicians to perform procedures requiring moderate sedation/analgesia, deep sedation/analgesia, general anesthesia, or regional anesthesia in a facility that has received accreditation from a Board-recognized organization. The facility will be responsible for the cost of the accreditation. Although the cost of the accreditation process will vary depending on the size of the office-based practice, the type of procedure performed and the accrediting agency, the average cost will be about $1,200 per year per office. The financial impact on the physician licensee is currently unknown as all efforts to collect data from affected parties have produced insignificant results.
Copies of these rules are now on file at the Indiana Government Center-South, 402 West Washington Street, Room W072 and Legislative Services Agency, One North Capitol, Suite 325, Indianapolis, Indiana and are open for public inspection.
