Dear Senator Young:

This is to notify you that pursuant to IC 4-22-2-19, the Alcohol and Tobacco Commission (ATC) will not begin the rulemaking process within sixty (60) days after the effective date of the statute that authorizes the rule. IC 7.1-3-1.5-16 mandates adoption of rules to carry out IC 7.1-3-1.5 concerning certification of alcohol server training programs. The ATC first initiated the rulemaking process by publication of a notice of intent on July 5, 2006 (LSA #06-194). Although we have had discussions with interested parties, we were not prepared to move forward with a proposed rule during 2006.

The ATC is now ready to move forward and we expect to start the rule promulgation process immediately. The Notice of Intent to Adopt [sic, a] Rule was posted on the Indiana Register site on July 4, 2007, and the corresponding LSA number is 07-367.
