Under IC 4-22-2-24, notice is hereby given that on July 26, 2007, at 1:30 p.m. EDT, at the National City Center, 101 West Washington Street, Suite 220, Room 222, Indianapolis, Indiana, the Indiana Utility Regulatory Commission will hold a public hearing on a proposed rule (RM #07-02, LSA Document #07-235) to amend 170 IAC 8.5-1-1 regarding definitions used in this article and to amend 170 IAC 8.5-3-1 through 170 IAC 8.5-3-3 regarding application for a Certificate of Territorial Authority for sewage disposal services.

This proposed rule updates and clarifies the instructions and requirements regarding application for a Certificate of Territorial Authority for sewage disposal services. No requirement or cost is imposed on any regulated entity under this rule that is not expressly required by the statute authorizing the Indiana Utility Regulatory Commission to adopt this rule.

As this proposed rule merely updates and clarifies existing requirements and does not impose any additional cost or requirement on any regulated entity, at the present time it does not appear to be necessary to set written and reply comment periods beyond the date of the public hearing. Consequently, any written comments should be submitted at, or in advance of, the public hearing. As is the usual practice, oral comments may be made on the record at the public hearing.
