TITLE 65 STATE LOTTERY COMMISSION

Emergency Rule

DIGEST

Temporarily adds rules concerning the draw game Hoosier Million Dollar Raffle. Effective June 13, 2007.


SECTION 1. The name of this draw game is "Hoosier Million Dollar Raffle".
SECTION 2. Definitions: The definitions in this SECTION shall apply throughout this rule [document].
(1) "Winning numbers" means the seven hundred seventy-seven (777) eight (8) digit numbers selected by the commission in a Raffle selection event with digits in the exact order of selection.
(2) "Raffle selection event" means the selection of numbers through the use of a random number generator computer software program conducted to determine the Raffle winning numbers.
(3) "Raffle ticket" means a draw ticket purchased in the manner defined in SECTION 4(a) of this rule [document] which meets all of the validation requirements of 65 IAC 5-2-5.
(4) "Play" means the sequential eight (8) digit numbers that appear on a valid Raffle ticket in the manner defined in SECTION 4(b) of this rule [document].
(5) "Player" means an eligible person who participates in a Raffle selection event by purchasing a Raffle ticket and/or claiming the prize.
(6) "Quick pick", for purposes of the Hoosier Million Dollar Raffle, means a play selected and generated by a commission-approved terminal. All numbers in a play are generated in sequential order statewide starting with "00000001" up to and including "00325000" until all available numbers have been generated.
(7) "Retailer" means a person or entity who sells lottery tickets on behalf of the state lottery commission as authorized by 65 IAC 3-1-1 et seq. and a retailer contract.
(8) "Terminal" means a device which is authorized by the commission to function in an on-line, interactive mode with the lottery's central computer system for the purpose of issuing lottery tickets and entering, receiving, and processing lottery transactions.

SECTION 3. Ticket price and content: The price of a Raffle ticket shall be twenty dollars ($20) per ticket. Each Raffle ticket shall contain one (1) play consisting of an eight (8) digit number and is valid for the Raffle selection event following its purchase. No two (2) Raffle tickets shall contain the same eight (8) digit number.

SECTION 4. Procedure for playing: (a) A Raffle ticket may be purchased by requesting a play and the retailer shall generate the Raffle ticket from the terminal. All plays in the Raffle shall be selected by means of quick pick. Play slips shall not be available or utilized for choosing or purchasing a Raffle ticket or a play.

(b) Each play for the Raffle shall consist of one (1) eight (8) digit number. Each number will be sequentially generated by the retailer terminal from a statewide database of numbers starting with "00000001" up to and including "00325000" until all available numbers have been generated.

(c) A Raffle ticket is the only valid proof of a play and the only valid receipt for claiming a prize in the Raffle.

(d) Sales of Raffle tickets shall be terminated on August 16, 2007, at 12:00 p.m. (EDST) or upon the sale of the last Raffle ticket, whichever occurs first.

(e) Neither the commission, the director, nor any employee of the commission shall be liable for the inability of any person to purchase a Raffle ticket containing a particular play.

(f) Notwithstanding 65 IAC 5-2-7 and 65 IAC 5-2-10, a Raffle ticket may not be canceled by a player or a retailer.

SECTION 5. Prize amount and determination of winner: (a) In the Raffle selection event there shall be seven hundred seventy-seven (777) prizes available. Each player presenting a valid Raffle ticket that contains one (1) of the winning numbers from the Raffle selection event will be awarded the prize that corresponds with such number.

(b) The prizes are as follows:
(1) Two (2) prizes of one million dollars ($1,000,000) each.
(2) Five (5) prizes of one hundred thousand dollars ($100,000) each. and
(3) Seven hundred seventy (770) prizes of one thousand dollars ($1,000) each.

(c) All prizes shall be paid in a single, lump sum payment less required federal and state income tax withholdings and any offsets required by IC 4-30-11-11.

SECTION 6. Determination of winning number: The director or her designee shall act as the drawing manager and shall be responsible for coordinating and conducting the Raffle selection event. The drawing manager shall conduct the Raffle selection event on or about August 16, 2007, at a time and place determined by the drawing manager and open to the public. The drawing manager shall randomly select seven hundred seventy (777) [sic] eight (8) digit numbers from among only those eight (8) digit numbers printed on Raffle tickets purchased prior to the Raffle selection event. The selection event shall be under the supervision of the lottery's security division and witnessed by an independent certified public accountant. Equipment used in the Raffle selection event shall be inspected by an independent certified public accountant before and after the Raffle selection event. The director may postpone the Raffle selection event to a future time and publicize the postponement if the director or the director's designee finds that the postponement is in the best interests of the commission or the public. Players need not be present at the Raffle selection event to win.

SECTION 7. Prize structure and odds of winning:

SECTION 8. Termination of liability: All liability of the commission and its members, officers, directors, and employees for any prize terminates upon the award of the prize or upon the expiration of one hundred eighty (180) days after the date of the Raffle selection event.

SECTION 9. Applicable statutes and rules: IC 4-30 Indiana State Lottery Act and 65 IAC 5 DRAW GAMES.

SECTION 10. This document expires July 1, 2008.
