IC 4-22-2.1-5 Statement Concerning Rules Affecting Small Businesses
Indiana Code 4-22-2.1-5 requires an agency to submit to the Legislative Services Agency and the Indiana Economic Development Corporation (IEDC) a statement of economic impact of any proposed rule with an economic impact on small businesses. The IEDC is required to review the rule and submit written comments to the agency not later than seven days before the public hearing.
The Division of Aging has reviewed this proposed rule to determine the economic impact of the rule on small businesses. The Division has determined, based on the information available at the time of promulgation, that the proposed rule imposes the following requirements or costs on small businesses.
The Adult Foster Care Program is a new service on the Aged and Disabled Medicaid Waiver. Currently there are not yet Adult Foster Care Medicaid Waiver providers in the state of Indiana.
Annual reporting costs are expected to be minimal.
The provider is required to keep records including a floor plan of the home, an emergency plan, three references, a plan describing the operation of the home, CPR/First Aid certifications for all caregivers, liability insurance documentation, and Medicaid Waiver provider agreements. The provider is also required to keep consumer files, including all personal information, the plan of care, legal documents if established, incident reports if applicable, weekly progress notes, any consumer financial records if applicable, and the consumer contract. Maintaining these records is already a standard practice for current Medicaid Waiver Providers so there should be no new compliance costs associated with this rule.
There were no data, studies, or analyses available or relied upon when determining cost of the Adult Foster Care rule on small business.
The rule establishes alternative methods determined to be less costly while still complying with all Medicaid Waiver rules.
