IC 4-22-2.1-5 Statement Concerning Rules Affecting Small Businesses
Estimated Number of Small Businesses Subject to this Rule:
312 IAC 8-2-6(d) Daily Horse Tags – None
312 IAC 8-2-8(g)(2) through 312 IAC 8-2-8(g)(6) Lake Permits – Small rental boat operators located off property are affected. With approximately 30 DNR properties charging this fee, then there could be at least a like amount of rentals in the vicinity of these properties that would have to have a permit on their rental boats. Previously, the cost of launching the boat was passed on to the renter, but, since the boat needs a permit on it, it had to be purchased by the owner of the boat.
312 IAC 2-4-6, 312 IAC 2-4-7, and 312 IAC 2-4-12 Fishing Tournament Fees – Small business would not be subject to this proposed rule.
312 IAC 8-2-16 Goose Pond Fish and Wildlife Area – None.

Estimated Average Annual Administrative Costs That Small Businesses Will Incur:
312 IAC 8-2-6(d) Daily Horse Tags – None. The rule does not affect small business.
312 IAC 8-2-8(g)(2) through 312 IAC 8-2-8(g)(6) Lake Permits – Some cost will be incurred by local boat rental operators to ensure permits are purchased and installed on private watercraft intended for use on DNR property lakes. Gas to travel and purchase permits will occur. If a marina operator under license to the DNR, postage for notification of permit requirements could occur as well as man-hours needed to inform slip renters of the proposed fee and administer other forms of communication to slip renters of the fee enforcement. Estimate to business owner for administering the internal DNR fee, however, should be minimal outside the actual purchase of the permit.
312 IAC 2-4-6, 312 IAC 2-4-7, and 312 IAC 2-4-12 Fishing Tournament Fees – There would be no annual reporting costs to small business.
312 IAC 8-2-16 Goose Pond Fish and Wildlife Area – None.

Estimated Total Annual Economic Impact on Small Businesses:
312 IAC 8-2-6(d) Daily Horse Tags – No impact is anticipated by small business with this fee.
312 IAC 8-2-8(g)(2) through 312 IAC 8-2-8(g)(6) Lake Permits – Economic impact would be hard to estimate as the DNR has no direct knowledge of the current impact rental boats have on our facility outside our properties. For rental boat concessions operating within the park boundaries, approximately 100 boats throughout the system may be available to rent, thus the fee statewide could amount to an increase to small business to be approximately $2,000.
312 IAC 2-4-6, 312 IAC 2-4-7, and 312 IAC 2-4-12 Fishing Tournament Fees – This proposed rule does not apply to small business so there would be no direct economic impact to small business. Indirect impact could be that if fewer tournaments were held in a community, some small businesses could claim loss of revenue due to less participation of tournaments.
312 IAC 8-2-16 Goose Pond Fish and Wildlife Area – None.

Justification Statement of Requirement or Cost:
312 IAC 8-2-6(d) Daily Horse Tags – No impact to small business.
312 IAC 8-2-8(g)(2) through 312 IAC 8-2-8(g)(6) Lake Permits – Only boat rentals outside DNR properties that rent boats for DNR lake use are affected and are limited to a handful at best of operators, probably not more than 30 but most likely less than that amount. The requirement to have a lake permit, regardless as to the owner of the boat, makes the rental owner pass the cost on to the customer. The DNR cannot have a system where internal customers have to pay and external customers do not when providing the same facilities to both. Currently, external boat rental operators rent boats and those renters must pay the entrance fees to the park. The entrance fees will still be paid by the renter, but the lake permit will have to be purchased ahead of time by the boat rental owner and most likely will pass this cost onto the customer.
312 IAC 2-4-6, 312 IAC 2-4-7, and 312 IAC 2-4-12 Fishing Tournament Fees – There would be no cost or requirement placed on small businesses by this proposed rule.
312 IAC 8-2-16 Goose Pond Fish and Wildlife Area – None.

Regulatory Flexibility Analysis of Alternative Methods:
312 IAC 8-2-6(d) Daily Horse Tags – No impact to regulatory reporting.
312 IAC 8-2-8(g)(2) through 312 IAC 8-2-8(g)(6) Lake Permits – There is no regulatory reporting required to boat rental operators. Boat owners purchase permits and apply them to the watercraft. No other requirements are needed.
312 IAC 2-4-6, 312 IAC 2-4-7, and 312 IAC 2-4-12 Fishing Tournament Fees – There is no regulatory reporting required by small business from this proposed rule.
312 IAC 8-2-16 Goose Pond Fish and Wildlife Area – None.
