TITLE 455 DIVISION OF AGING

Notice of Intent to Adopt a Rule

Under IC 4-22-2-23, the Division of Aging intends to adopt a rule concerning the following:

OVERVIEW: Adds 455 IAC 4 for assisted living Medicaid waiver services. It is identical to, and will replace, the current rules at 460 IAC 8 except for amendments to establish the requirement of an initial survey completed by the Division of Aging as part of the certification process for assisted living waiver service providers. It includes clarification of sections regarding the single occupancy requirement and other requirements for Medicaid providers of assisted living services provided through a home and community based services waiver. It eliminates the requirement of consumer access to a stovetop or oven for food preparation in a common area of the assisted living facility. It sets a specific start time and completion time limit for a consumer's service plan. Finally, it adds necessary definitions. Written comments may be submitted to the Small Business Regulatory Coordinator for the rule. Statutory authority: IC 12-8-8-4; IC 12-9.1-2-3.
