Subject: Registration of Significant Water Withdrawal Facilities
1. Application and Purpose of Information Bulletin
The Natural Resources Commission is responsible for administration of
IC 14-25-7 (sometimes referred to as the "Water Resource Management Act"). A key provision of the Act requires the owner of each "significant water withdrawal facility" to register a facility within three months after the facility is completed. The owner of a registered significant water withdrawal facility must, within three months after the end of each year, make a verified report to the Commission on forms to be provided by the Commission of the amounts of water withdrawn during the year.
The phrase "significant water withdrawal facility" is defined by statute at
IC 14-25-7-15(a). The phrase means the water withdrawal facilities of a person that, in the aggregate from all sources and by all methods, has the capability of withdrawing more than 100,000 gallons of ground water, surface water, or ground and surface water combined in one day. The phrase does not mean:
(1) water withdrawal facilities that function as part of the operation or construction of a landfill; or
(2) water withdrawal facilities located in or on an off-stream impoundment that is principally supplied by a significant water withdrawal facility.
The purpose of this information bulletin is to assist in implementation of
IC 14-25-7 with respect to the following:
The registration of significant water withdrawal facilities.
The submission of annual reports for registered significant water withdrawal facilities.
The Director of the Division of Water, Department of Natural Resources, (the "Division Director") may perform all functions necessary or proper for the registration and reporting of significant water withdrawal facilities. Included in this authorization are each of the following:
The design and distribution of forms to register significant water withdrawal facilities and forms to report upon annual withdrawals from registered significant water withdrawal facilities. Simultaneously with approval of this information bulletin, the Commission approved forms for these purposes.
The initiation and prosecution of any administrative or civil action for the enforcement of
IC 14-25-7. In addition, the Division Director may disapprove any registration or annual report found to be inaccurate or incomplete. An administrative decision made under this part of the information bulletin is subject to administrative review under
IC 4-21.5.

Information Bulletin #29 (23 IR 3233 (2000)) superseded Department of Natural Resources, Division of Water, Information Bulletin No. 1 (published at 7 IR 2431 (1984)) issued with respect to the same subject. The original information bulletin was published in Volume 7 of the Indiana Register, beginning at page 7 IR 2431, on September 1, 1984. Information Bulletin 29 was upon its publication in Volume 23 of the Indiana Register, beginning at page 23 IR 3233, on September 1, 2000. On November 14, 2006, the Commission reaffirmed the information bulletin.
