Notice of Public Hearing

Under IC 4-22-2-24, notice is hereby given that on December 14, 2006, at 9:30 a.m. EST, at the Indiana Government Center-South, 302 West Washington Street, Room E306, Indianapolis, Indiana, the Indiana Utility Regulatory Commission will hold a public hearing on a proposed rule (RM #06-05, LSA Document #06-429) to require customer notification when a telecommunications service provider communicates with a residential customer about changing from basic to nonbasic telecommunications services. The customer notification will indicate the regulatory protections the customer would be forgoing by switching from basic to nonbasic telecommunications services.
No requirement or cost is imposed on a telecommunications service provider under this rule that is not expressly required by the statute authorizing the Indiana Utility Regulatory Commission to adopt this rule. Representatives of the telecommunications industry have provided the Indiana Utility Regulatory Commission with an estimation of the annual costs that would be incurred under this rule. Particularly considering this rule will be effective for a limited time, these costs are justified by the importance of providing consumer protection at a time of increasing deregulation of telecommunications services. Pursuant to IC 4-22-2-23.1, the Indiana Utility Regulatory Commission has solicited informal comments from, and held prerulemaking workshops with, representatives of the Indiana telecommunications industry and the Indiana Office of Utility Consumer Counselor. As a result, at the present time it does not appear to be necessary to set written and reply comment periods beyond the date of the public hearing. Consequently, any written comments should be submitted at, or in advance of, the public hearing.
Copies of these rules are now on file at the Indiana Government Center-South, 302 West Washington Street, Room E306 and Legislative Services Agency, One North Capitol, Suite 325, Indianapolis, Indiana and are open for public inspection.
