Re: LSA Doc. #06-10 -- Proposed rule to establish certification and regulation of emergency medical dispatcher agencies and dispatchers to implement IC 16-31-3.5 to be adopted by the Emergency Medical Services Commission

Dear Representative Murphy,

On behalf of the Emergency Medical Services Commission (Commission), I am submitting this notice to the Administrative Rules Oversight Committee in compliance with IC 4-22-2-19, which requires an agency to begin the rulemaking process not later than sixty (60) days after the effective date of the statute that authorizes the rule. The requirement for certification of emergency medical dispatchers and emergency medical dispatch agencies was a completely new field of regulation for the Commission. IC 16-31-3.5 was enacted specifically to give them this new authority. The Commission determined that it was best to obtain input from those who were going to be regulated for the first time. Due to the quantity and quality of the input received by the Commission on the substantive nature of the proposed regulation, the statute was amended in 2005 (P.L.22-2005, SEC. 24) to extend the date by which certification had to be obtained until December 31, 2006. As a result of the comments received, the Commission is in the process of preparing detailed fiscal impact analyses. The Commission expects that the rule can be approved by the Governor by November 1, 2007.

This notice setting forth the expected date of approval of LSA Doc. #06-10 as November 1, 2007, is being submitted in a timely manner. October 8, 2006, is the two hundred and fiftieth day after publication of the notice of intent to adopt a rule.

Your understanding of these circumstances is greatly appreciated. If you need additional information, please do not hesitate to contact me at 233-5341.

Yours truly,

Mara J. Snyder, Director
