Temporarily amends 312 IAC 8-2-3, governing DNR properties, and 312 IAC 9-3-4, 312 IAC 9-3-14, and 312 IAC 9-4-11, which govern the possession of firearms while engaging in hunting activities, to allow a person with a valid Indiana handgun carry permit issued under IC 35-47-2-6 or a carry permit recognized by Indiana under IC 35-47-2-21(b) to possess a handgun on a DNR property or while engaged in hunting. Effective September 21, 2006.

SECTION 1. 312 IAC 8-2-3 is temporarily amended to add a new subsection (a)(4) to read as follows: (4) The firearm is a handgun possessed under a license issued pursuant to IC 35-47-2-3 or a license recognized pursuant to IC 35-47-2-21(b).

SECTION 2. 312 IAC 8-3-4 [sic., 312 IAC 9-3-4] is temporarily amended to strike subsection (g) and to add a new subsection (g) [sic., to] read as follows: (g) A person must not hunt under this SECTION unless that person possesses one (1) bow. A person must not possess a firearm while hunting under this SECTION, unless the firearm is a handgun possessed under a license issued pursuant to IC 35-47-2-3 or a license recognized pursuant to IC 35-47-2-21(b).

SECTION 3. 312 IAC 9-3-14 is temporarily amended to strike subsection (c) and to add a new subsection (c) [sic., to] read as follows: (c) A person must not possess a firearm, air rifle, or another device capable of taking a raccoon or opossum while chasing a raccoon or opossum during the chasing season established under subsection (a)(3), unless the firearm is a handgun possessed under a license issued pursuant to IC 35-47-2-3 or a license recognized pursuant to IC 35-47-2-21(b).

SECTION 4. 312 IAC 9-4-11 is temporarily amended to strike subsection (i) and to add a new subsection (i) [sic., to] read as follows: (i) A person must not possess a handgun while hunting wild turkeys, unless the handgun is possessed under a license issued pursuant to IC 35-47-2-3 or a license recognized pursuant to IC 35-47-2-21(b).

SECTION 5. SECTION 1 through SECTION 4 of this document [SECTIONS 1 through 4 of this document] expire one (1) year from the effective date of this document.
