Notice of Public Hearing
Under
IC 4-22-2-24, notice is hereby given that on October 4, 2006 at 10:00 a.m., at the Brown County Public Library, Conference Room C, 205 Locust Lane, Nashville, Indiana the Natural Resources Commission will hold a public hearing on proposed amendments adding
312 IAC 10.5, governing the regulation of dams, to clarify definitions for the implementation of
IC 14-27-7.5.
The DNR is required by
IC 14-27-7.5-8(b) to establish by rule the criteria for assigning a hazard classification to dams. The classification must include "high hazard", "significant hazard", and "low hazard". The rule proposal seeks to implement this statutory mandate.
IC 14-27-7.5 (particularly
IC 14-27-7.5-9) sets forth regulatory requirements applicable to the owners of dams, but the rules do not impose requirements or costs under
IC 4-22-2-24(d)(3) other than those set forth in the statute.
Copies of these rules are now on file with the Natural Resources Commission at the Indiana Government Center-South, 402 West Washington Street, Room W272 and Legislative Services Agency, One North Capitol, Suite 325, Indianapolis, Indiana and are open for public inspection.
