Temporarily amends 312 IAC 9-3-3 to clarify the license requirements for the firearms and muzzle loader seasons for hunting deer. Amends 312 IAC 9-3-5 to clarify the license requirements for hunting deer in an urban deer zone and remove Madison from the list of urban deer zones. Amends 312 IAC 9-3-7 to govern hunting white-tailed deer in a designated county under an extra deer license and identify counties for herd reduction. Effective September 1, 2006.


SECTION 1. (a) This SECTION of this document supercedes 312 IAC 9-3-3(a) and governs hunting deer by firearms.

(b) An individual may take a deer under this SECTION of this document who is either:
(1) issued a license to hunt deer by firearms under IC 14-22-12-1(a)(12) or IC 14-22-12-1(a)(15) during the season established in 312 IAC 9-3-3(b); or
(2) issued a license to hunt deer by a muzzle loading gun or muzzle loading handgun under IC 14-22-12-1(a)(13) or IC 14-22-12-1(a)(16) during the season established in 312 IAC 9-3-3(c); or
(3) issued a lifetime license under IC 14-22-12-7 prior to July 1, 2005, during the seasons established in 312 IAC 9-3-3(b) and (c) [312 IAC 9-3-3(b) and 312 IAC 9-3-3(c)]; or
(4) issued a youth yearly consolidated hunting license under IC 14-22-12-1(a)(24); or
(5) hunting by the use of firearms under IC 14-22-11-1.

SECTION 2. (a) This SECTION of this document supercedes 312 IAC 9-3-5 and governs hunting deer with bow and arrows by authority of an extra deer license.

(b) An individual may take a deer under this SECTION of this document who is either:
(1) issued a license to take an extra deer under IC 14-22-12-1(a)(18), IC 14-22-12-19(a)(19), IC 14-22-12-1(a)(24), or IC 14-22-12-7 by means of a bow and arrows; or
(2) hunting under IC 14-22-11-1 by means of a bow and arrows.

(c) Except as specified in subsection (d), the statewide seasonal limit for hunting under this SECTION is one (1) deer of either sex. After August 31, 2007, a person must not take an antlered deer by means of a crossbow.

(d) The restrictions contained in 312 IAC 9-3-2, 312 IAC 9-3-4(c), and 312 IAC 9-3-4(e) through 312 IAC 9-3-4(j) also apply to a license issued under this SECTION of this document.

(e) The seasonal limit for hunting deer in an urban deer zone is four (4) deer of which only one (1) may be antlered. A person must possess a valid extra deer license, lifetime license, or youth yearly consolidated hunting license for each deer taken or be exempted from a license under IC 14-22-11-1. A deer taken under this subsection does not count against a bag limit for deer set in 312 IAC 9-3 or elsewhere in this document.

(f) The following areas have been designated as urban deer zones:
(1) The Indianapolis urban deer zone includes the following:
(A) All of Marion County.
(B) That portion of Hendricks County east of State Highway 267.
(C) The southeast portion of Boone County as bounded by the following:
(i) State Highway 267.
(ii) Interstate Highway 65.
(iii) State Highway 32.
(D) That portion of Hamilton County south of State Highway 32.
(2) The Fort Wayne urban deer zone includes that portion of Allen County lying within the bounds of Interstate Highway 69 and State Highway 469.
(3) The Evansville urban deer zone includes all of Vanderburgh County.
(4) The Lafayette urban deer zone includes the portion of Tippecanoe County north of State Highway 28.
(5) The Gary urban deer zone includes that portion of Lake County north of U.S. Highway 30.
(6) The Crown Point urban deer zone includes that portion of Lake County within the corporate limits of Crown Point.
(7) The Chesterton urban deer zone includes the portion of Porter County north of U.S. Highway 94.
(8) The Michigan City urban deer zone includes that portion of LaPorte County north of U.S. Highway 94.

SECTION 3. (a) As anticipated by 312 IAC 9-3-7, this SECTION of this document governs hunting deer under an extra deer license.

(b) This SECTION of this document is supplemental to 312 IAC 9-3-2 and governs the activities of an individual who is either:
(1) issued a license to take an extra deer under IC 14-22-12-1(a)(18), IC 14-22-12-1(a)(19), IC 14-22-12-1(a)(24), or IC 14-22-12-7; or
(2) hunting under IC 14-22-11-1.

(c) A person must not take an antlerless deer under this SECTION unless the person possesses an antlerless deer license issued by the department of natural resources, division of fish and wildlife, under this SECTION of this document.

(d) The season for hunting deer under this SECTION of this document is as follows:
(1) From October 1, 2006, through December 3, 2006, with bow and arrows.
(2) From November 18, 2006, through December 3, 2006, with firearms.
(3) From December 9, 2006, through December 24, 2006, with muzzle loading guns.
(4) From December 9, 2006, through January 7, 2007, with bow and arrows or crossbows.

(e) The seasonal limit for hunting under this SECTION of this document is one (1) antlerless deer for each license issued under this SECTION of this document.

(f) A person who hunts under this SECTION of this document must obtain an extra deer license for each deer.

(g) A person who hunts under this SECTION of this document may use bow and arrows, crossbow, or any firearms that may otherwise be lawfully used to take deer under 312 IAC 9-3.

(h) 312 IAC 9-3-3(d) through 312 IAC 9-3-3(g) and 312 IAC 9-3-4(e) through 312 IAC 9-3-4(j) apply to a license issued under this SECTION of this document.

(i) A person must not exceed the county bag limit from each county as follows:
(1) Adams - 2.

(j) The extra deer license authorized by this SECTION of this document does not apply to the department properties listed in this subsection. The license is invalid on these properties:
(1) Atterbury Fish and Wildlife Area.
(2) Blue Grass Fish and Wildlife Area.
(3) Chinook Fish and Wildlife Area.
(4) Crosley Fish and Wildlife Area.
(5) Fairbanks Landing Fish and Wildlife Area.
(6) Francis Slocum State Forest.
(7) Glendale Fish and Wildlife Area.
(8) Green-Sullivan State Forest.
(9) Hillenbrand Fish and Wildlife Area.
(10) J. Roush Lake (including adjacent lands administered by the department of natural resources).
(11) Kankakee Fish and Wildlife Area.
(12) Kingsbury Fish and Wildlife Area.
(13) Lasalle Fish and Wildlife Area.
(14) Mississinewa Lake (including adjacent lands administered by the department of natural resources).
(15) Patoka Lake, except east of State Road 145 (in Orange County and Crawford County) and south of State Road 164 (in Dubois County and Crawford County).
(16) Pigeon River Fish and Wildlife Area.
(17) Salamonie Lake (including adjacent lands administered by the department of natural resources).
(18) Salamonie State Forest.
(19) Splinter Ridge Fish and Wildlife Area.
(20) Stucker Fork Wildlife Management Area.
(21) Sugar Ridge Fish and Wildlife Area.
(22) Tri-County Fish and Wildlife Area.
(23) Wilbur Wright Fish and Wildlife Area.
(24) Willow Slough Fish and Wildlife Area.
(25) Winamac Fish and Wildlife Area.

SECTION 4. This document expires on February 1, 2007.
