Under IC 4-22-2-24, notice is hereby given that on August 31, 2006 at 10:10 a.m., at the Indiana Government Center-South, 402 West Washington Street, Room W064, Indianapolis, Indiana the Indiana Real Estate Commission will hold a public hearing on proposed amendments to increase the validity of a temporary practice permit from six months to 12 months.
The Real Estate Appraiser Licensure and Certification Board (Board) has the authority to recommend to the Indiana Real Estate Commission (Commission) rules governing the real estate appraisers licensed and certified under IC 25-34.1-3-8. The proposed rule amends 876 IAC 3-3-21 to increase the validity of a temporary permit from six months to 12 months and removes the requirement of licensees requesting an extension of their temporary permit. This proposed rule also addresses the federal requirements for state appraiser licensing boards to comply with Title XI and Appraisal Subcommittee Policy Statement No.: 5. Title XI, Policy Statement No.: 5, states that, "State appraiser certifying or licensing agency shall not impose excessive fees or burdensome requirements, as determined by the ASC, for temporary practice. The ASC considers the prohibiting temporary practice, limiting the valid time period of a temporary practice permit to less than six months after its issuance date, not providing a temporary practitioner with an effortless method of obtaining an extension of the time period, and charging a temporary practice fee exceeding $150 as excessive fees or burdensome requirements.
Copies of these rules are now on file at the Indiana Government Center-South, 402 West Washington Street, Room W072 and Legislative Services Agency, One North Capitol, Suite 325, Indianapolis, Indiana and are open for public inspection.
