Synopsis: Race and sex-selective abortions. Prohibits a person from performing an abortion if the person knows that the pregnant woman is seeking the abortion because of: (1) the sex of the fetus; (2) the race of the fetus; or (3) the race of the parent. Makes it a Class C felony if a person knowingly or intentionally commits a sex-selective or race-selective abortion.

Effective: July 1, 2013.

    A BILL FOR AN ACT to amend the Indiana Code concerning health.

Be it enacted by the General Assembly of the State of Indiana:

     Chapter 3. Sex-Selective and Race-Selective Abortion Ban
     Sec. 1. As used in this chapter, "race-selective abortion" means an abortion that is performed solely because of the race of the fetus or the race of a parent.
     Sec. 2. As used in this chapter, "sex-selective abortion" means an abortion that is performed solely because of the gender of the fetus.
     Sec. 3. (a) A person may not intentionally perform or attempt to perform an abortion before the earlier of viability of the fetus or twenty (20) weeks of postfertilization age if the person knows that the pregnant woman is seeking a sex-selective abortion.
     (b) A person may not intentionally perform or attempt to perform an abortion after viability or twenty (20) weeks of postfertilization if the person knows that the pregnant woman is seeking a sex-selective abortion.
     Sec. 4. (a) A person may not intentionally perform or attempt to perform an abortion before the earlier of viability of the fetus or twenty (20) weeks of postfertilization age if the person knows that the pregnant woman is seeking a race-selective abortion.
     (b) A person may not intentionally perform or attempt to perform an abortion after viability or twenty (20) weeks of postfertilization if the person knows that the pregnant woman is seeking a race-selective abortion.
    Sec. 5. (a) A person who knowingly or intentionally performs an abortion in violation of this chapter commits a Class C felony.
    (b) In addition to the criminal penalty under subsection (a), a person who violates this chapter may be subject to disciplinary sanctions under IC 25-1-9.
