Synopsis: Unsafe buildings. Allows an enforcement authority to order
a first mortgage holder to take certain actions under the unsafe building
law with respect to an unsafe building or structure that has been
vacated by the owner as the result of a judgment of foreclosure or for
which the mortgage debt has been discharged in a bankruptcy
proceeding.
Effective: July 1, 2007.

A BILL FOR AN ACT to amend the Indiana Code concerning local
government.
Be it enacted by the General Assembly of the State of Indiana:

SECTION 1. IC 36-7-9-5.5 IS ADDED TO THE INDIANA CODE
AS A
NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
1, 2007]:
Sec. 5.5. An enforcement authority may, in accordance
with section 5 of this chapter, order a first mortgage holder with
respect to a building or structure declared unsafe by the
enforcement authority to:
(1) vacate the unsafe building or structure;
(2) seal the unsafe building or structure;
(3) exterminate vermin in and about the unsafe building or
structure;
(4) remove trash, debris, or fire hazardous material from the
unsafe building or structure; or
(5) repair or rehabilitate the unsafe building or structure;
if the unsafe building or structure has been vacated by the owner
as the result of a judgment of foreclosure in favor of the first
mortgage holder or if the mortgage debt has been discharged in a
bankruptcy proceeding filed by the owner.
