A BILL FOR AN ACT concerning environmental law.
SECTION 1. [EFFECTIVE JULY 1, 2007] (a) As used in this
SECTION, "concentrated animal feeding operation" has the
meaning set forth in IC 13-11-2-38.3.
(b) Notwithstanding IC 13-18-10-1 or any other law, the
department of environmental management may not approve after
June 30, 2007, and before July 1, 2010, the start of construction of
a concentrated animal feeding operation, regardless of whether the
application for approval was submitted to the department before
July 1, 2007.
(c) Notwithstanding IC 13-18-10-1(b) or any other law,
obtaining an NPDES permit for a concentrated animal feeding
operation after June 30, 2007, and before July 1, 2010, does not
meet the requirements of IC 13-18-10-1(a) and 327 IAC 16 to
obtain an approval to start construction of a concentrated animal
feeding operation.
(d) This SECTION expires July 1, 2010.
