A BILL FOR AN ACT to amend the Indiana Code concerning
education.
Be it enacted by the General Assembly of the State of Indiana:

SECTION 1. IC 20-26-5-31 IS ADDED TO THE INDIANA CODE
AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
1, 2007]: Sec. 31. (a) If a school corporation, including a school city
(as defined in IC 20-25-2-12), establishes a school corporation
police department, the governing body of the school corporation
shall adopt a policy that requires every individual appointed as a
school corporation police officer to complete training and
education, approved by the state board, that will enable the school
corporation police officer to appropriately deal with individuals
with autism and Asperger's syndrome.
(b) This subsection applies to a regular or special police officer
who is assigned as a security police officer for a school corporation
under IC 36-8-3-7. The governing body of the school corporation
to which the police officer is assigned shall ensure that the police
officer receives training and education, approved by the state
board, that will enable the police officer to appropriately deal with
individuals with autism and Asperger's syndrome.

SECTION 2. IC 20-28-3-4, AS ADDED BY P.L.1-2005, SECTION
12, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE JULY 1,
2007]: Sec. 4. A governing body may adjourn the governing body's
schools for not more than three (3) days in a school year to allow
teachers, school administrators, and paraprofessionals to participate
in:
(1) a session concerning agricultural instruction conducted in the
county;
(2) a meeting of a teachers' association; or
(3) a visitation of model schools under a governing body's
direction; or
(4) a basic or inservice course of education and training on
autism that is certified by the state board in conjunction with
the state health commissioner and any other appropriate
entity determined by the state board.
A governing body shall pay a teacher the teacher's per diem salary for
the teacher's participation.

SECTION 3. [EFFECTIVE JULY 1, 2007]
(a) An individual who
is appointed as a school corporation police officer before January
1, 2007, must begin the autism and Asperger's syndrome training
and education required by IC 20-26-5-31, as added by this act, not
later than January 1, 2008. However, an individual who is unable
to begin the training and education by January 1, 2008, due to the
existence of a waiting list for the training and education must begin
the training and education as soon as possible after January 1,
2008.
(b) An individual who is appointed as a school corporation
police officer after December 31, 2006, and before July 1, 2007,
must begin the autism and Asperger's syndrome training and
education required by IC 20-26-5-31, as added by this act, not later
than one (1) year after the individual's appointment. However, an
individual who is unable to begin the training and education within
one (1) year after the individual's appointment due to the existence
of a waiting list for the training and education must begin the
training and education as soon as possible after the expiration of
the one (1) year period.
(c) Notwithstanding IC 20-26-5-31, as added by this act, an
individual who is appointed as a school corporation police officer
before July 1, 2007, and who is unable to complete the training and
education required by IC 20-26-5-31, as added by this act, by July
1, 2010, due to the existence of a waiting list for the training and
education, must complete the training and education as soon as
possible after July 1, 2010.
(d) This SECTION expires January 1, 2011.
