Synopsis: Gas tax. Increases the appropriation from the motor vehicle
highway account for grant-in-aid subsidies to counties for the salaries
of full-time county highway engineers. Makes an appropriation from
the motor vehicle highway account of grant-in-aid subsidies to counties
for the salaries of county highway supervisors that attain specified
educational achievements with respect to the road scholar program
offered by the local technical assistance program. Makes an
appropriation from the motor vehicle highway account for grant-in-aid
subsidies to cities for the salaries of city traffic engineers who are
registered professional engineers.

HOUSE BILL No. 1713
A BILL FOR AN ACT to amend the Indiana Code concerning
taxation and to make an appropriation.
Be it enacted by the General Assembly of the State of Indiana:

SECTION 1. IC 8-17-3-11 IS ADDED TO THE INDIANA CODE
AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
1, 2005]: Sec. 11. (a) The county highway supervisor fund is
established.
(b) The fund is established to assist the counties in the
employment of county highway supervisors who have attained the
designations of the road scholar program offered by the Indiana
local technical assistance program, Purdue University, as described
in section 12 of this chapter.
The fund must be used exclusively for this purpose.
(c) The fund shall be administered by the auditor of state.
(d) The expenses of the fund shall be paid from money in the
fund.
(e) The treasurer of state shall invest the money in the fund not
currently needed to meet the obligations of the fund in the same
manner as other public money may be invested. Interest that
accrues from these investments shall be deposited in the fund.
(f) The fund consists of appropriations made under subsection
(g).
(g) There is annually appropriated from the counties' share of
the April distribution of the motor vehicle highway account one
million three hundred eighty thousand dollars ($1,380,000) to be
held by the auditor of state in the fund.
(h) Any balance in the fund at the end of each calendar year
shall be returned to the counties' share of the motor vehicle
highway account to be distributed in January of the following year.

SECTION 2. IC 8-17-3-12 IS ADDED TO THE INDIANA CODE
AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
1, 2005]: Sec. 12. Upon annual receipt of the appropriate
documentation from the county auditor, the auditor of state shall
distribute from the county highway supervisor fund to each county
a grant-in-aid subsidy that is to be applied toward the county
highway supervisor's annual salary, in the following amounts:
(1) Fifteen thousand dollars ($15,000), if the county highway
supervisor has attained the designation of master road builder
in the road scholar program offered by the Indiana local
technical assistance program, Purdue University.
(2) Seven thousand five hundred dollars ($7,500), if the county
highway supervisor has attained the designation of road
builder in the road scholar program offered by the Indiana
local technical assistance program, Purdue University.

SECTION 3. IC 8-17-3-13 IS ADDED TO THE INDIANA CODE
AS A
NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
1, 2005]:
Sec. 13. (a) As used in this section, "consumer price
index" refers to the seasonally unadjusted United States City
Average Consumer Price Index for All Urban Workers for all
items with reference to the index base period 1982-1984 (equal to
100), as published by the Bureau of Labor Statistics of the United
States Department of Labor.
(b) The dollar amounts in sections 11 and 12 of this chapter
correspond to the value of the consumer price index in January
2005.
(c) The dollar amounts in sections 11 and 12 of this chapter are
subject to annual adjustment as determined in STEP FOUR of the
following formula:
STEP ONE: Determine the consumer price index for January
2005. If the Bureau of Labor Statistics changes the index base
period of the consumer price index from that specified in
subsection (a), adjust the consumer price index for January
2005 to conform with the new index base period.
STEP TWO: Determine the consumer price index for January
of the year in question.
STEP THREE: Divide the STEP TWO amount by the STEP
ONE amount.
STEP FOUR: Multiply the number to be adjusted by the
STEP THREE amount, rounding to the nearest hundred
dollars.

SECTION 4. IC 8-17-5-8 IS AMENDED TO READ AS FOLLOWS
[EFFECTIVE JULY 1, 2005]: Sec. 8. There is annually appropriated
from the counties' share of the April distribution of the motor vehicle
highway account, three million nine two hundred twenty thousand
dollars ($920,000) ($3,220,000) to be held by the auditor of state in a
special account known as the county highway engineer fund. The fund
must be used exclusively in assisting the counties in the employment
of a full-time county highway engineer.

SECTION 5. IC 8-17-5-10 IS AMENDED TO READ AS
FOLLOWS [EFFECTIVE JULY 1, 2005]: Sec. 10. Upon receipt of the
annual certification from the county auditor, the auditor of state shall
distribute from the county highway engineer fund to each county a
grant-in-aid subsidy of twenty thirty-five thousand dollars ($20,000)
($35,000) that is to be applied toward the engineer's annual salary. If
the county highway engineer is employed by two (2) counties acting
jointly, the amount distributed to each county is ten seventeen
thousand five hundred dollars ($10,000) ($17,500).

SECTION 6. IC 8-17-5-14 IS ADDED TO THE INDIANA CODE
AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
1, 2005]:
Sec. 14. (a) As used in this section, "consumer price

SECTION 7. IC 36-9-7-6 IS ADDED TO THE INDIANA CODE
AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
1, 2005]: Sec. 6. (a) The city traffic engineer fund is established.
(b) The fund is established to assist the cities in the employment
of a registered professional engineer in the position of city traffic
engineer. The fund must be used exclusively for this purpose.
(c) The fund shall be administered by the auditor of state.
(d) The expenses of the fund shall be paid from money in the
fund.
(e) The treasurer of state shall invest the money in the fund not
currently needed to meet the obligations of the fund in the same
manner as other public money may be invested. Interest that
accrues from these investments shall be deposited in the fund.
(f) The fund consists of appropriations made under subsection
(g).
(g) There is annually appropriated from the cities' share of the
September distribution of the motor vehicle highway account
money sufficient to fund the grant-in-aid subsidies described in
section 8 of this chapter.
(h) Any balance in the fund at the end of each calendar year
shall be returned to the cities' share of the motor vehicle highway
account to be distributed in January of the following year.

SECTION 8. IC 36-9-7-7 IS ADDED TO THE INDIANA CODE
AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
1, 2005]: Sec. 7. The fiscal officers of cities that employ a registered
professional engineer in the position of city traffic engineer shall
annually certify that employment to the auditor of state. The
certification must show the name and address of the city traffic
engineer and the serial number of the engineer's certificate of
registration issued by the state board of registration for
professional engineers.

SECTION 9. IC 36-9-7-8 IS ADDED TO THE INDIANA CODE

the annual salary of a city traffic engineer who is a registered
professional engineer.
