Synopsis: Prohibit taking of endangered species. Imposes a civil fine
of $500 for a first violation and $1,000 for subsequent violations, in
addition to criminal penalties, upon a person who violates a law
concerning unlawfully taking or possessing an endangered species.
Effective: July 1, 1999.

A BILL FOR AN ACT to amend the Indiana Code concerning
natural and cultural resources.
SECTION 1.
IC 14-8-2-85
IS AMENDED TO READ AS
FOLLOWS [EFFECTIVE JULY 1, 1999]: Sec. 85. "Endangered
species", for purposes of IC 14-22-34, IC 14-22, has the meaning set
forth in
IC 14-22-34-1.
SECTION 2.
IC 14-22-38-4
IS AMENDED TO READ AS
FOLLOWS [EFFECTIVE JULY 1, 1999]: Sec. 4. (a) A person who:
(1) unlawfully takes or possesses a deer, or a wild turkey, or an
endangered species;
(2) takes or possesses a deer, or a wild turkey, or an endangered
species by illegal methods or with illegal devices; or
(3) sells, offers to sell, purchases, or offers to purchase:
(A) a deer, or a wild turkey, or an endangered species; or
(B) a part of a deer, or a wild turkey, or an endangered
species;
shall reimburse the state five hundred dollars ($500) for the first
violation and one thousand dollars ($1,000) for each subsequent
violation.
(b) The money shall be deposited in the conservation officers fish
and wildlife fund. This penalty is in addition to any other penalty under
the law.
