On June 3, 2003, this Court appointed the Hon. Daniel C. Banina as special judge in these cases in the Miami Circuit Court following a praecipe for withdrawal of submission from the original presiding judge in this matter, the Hon. Bruce Embrey. Judge Embrey retired from the bench effective November 1, 2002; the Hon. Rosemary Higgins Burke is now the presiding judge of the Miami Circuit Court. Judge Burke has now filed with this Court her Request for Appointment as Special Judge in these matters, stating therein that (1) the parties consent to such an appointment; (2) Special Judge Banina has no objection to this appointment; and (3) the interests of justice and judicial economy will be served by her appointment as special judge to these matters.
And this Court, being duly advised, now finds that Judge Burke’s request should be granted.
IT IS, THERFORE, ORDERED that the Hon. Daniel J. Banina is relieved of his appointment as special judge in these cases in the Miami Circuit Court.
IT IS FURTHER ORDERED that the Hon. Rosemary Higgins Burke is appointed as special judge in this cases in the Miami Circuit Court. This Order vests jurisdiction in Special Judge Burke. Pursuant to Trial Rule 79(K), an oath of office is not required.
The clerk of this Court is directed to forward notice of this Order to the Hon. Rosemary Higgins Burke; to the Hon. Daniel J. Banina; and to the clerk of the Miami Circuit Court.
The clerk of the Miami Circuit Court is directed to forward notice of this order to all parties of record in the case below.
