ORDER APPOINTING SPECIAL JUDGE

      Comes now the Honorable John M. Marnocha, District Administrative Judge, and on his own motion remands this cause to the Court for appointment of a special judge.

      And this Court, being duly advised, now finds that, a special judge should be appointed to hear this matter in the Elkhart Superior Court No. 2 pursuant to Ind.Trial Rule 79(H)(3).

      IT IS, THEREFORE, ORDERED that the Honorable Robert W. Gilmore, Jr. is appointed as special judge to hear this matter in the Elkhart Superior Court No. 2. This order vests jurisdiction in Judge Gilmore. Pursuant to Ind.Trial Rule 79(K), an oath of office is not required.

      The Clerk of this Court is directed to forward notice of this Order to the Hon. John M. Marnocha, St. Joseph Superior Court, 101 South Main Street, South Bend, IN 46601-1807; to the Hon. Robert W. Gilmore, Jr., LaPorte Circuit Court, 813 Lincoln Way, LaPorte, IN 46350-3429; and to the Clerk of the Elkhart Superior Court.

      The Clerk of the Elkhart Superior Court is directed to forward notice of this Order to all parties of record in the case below.
