ORDER APPOINTING SPECIAL JUDGE

      Comes now the Honorable Richard A. Dailey, Judge of the Delaware Circuit Court 2, and on his own motion remands this cause to the Court for appointment of a special judge.

      And this Court, being duly advised, now finds that, a special judge should be appointed to hear this matter in the Delaware Circuit Court 2 pursuant to Ind.Trial Rule 79(H)(3).

      IT IS, THEREFORE, ORDERED that the Honorable Michael D. Peyton is appointed as special judge to hear this matter in the Delaware Circuit Court 2. This order vests jurisdiction in Judge Peyton. Pursuant to Ind.Trial Rule 79(K), an oath of office is not required.

      The Clerk of this Court is directed to forward notice of this Order to the Hon. Richard A. Dailey, Delaware Circuit Court 2, 100 West Washington Street, Muncie, IN 47305-2868; to the Hon. Michael D. Peyton, Henry Superior Court, 1215 Race Street, # 320, New Castle, IN 47362; and to the Clerk of the Delaware Circuit Court 2.

      The Clerk of the Delaware Circuit Court 2 is directed to forward notice of this Order to all parties of record in the case below.
