ORDER APPOINTING SPECIAL JUDGE
Comes now the Honorable Daniel F. Donahue, Judge of the Clark Circuit Court, and remands this cause to the Court for appointment of a special judge.
And this Court, being duly advised, now finds that, a special judge should be appointed to hear this matter in the Clark Circuit Court pursuant to Ind.Trial Rule Ind.Crim.Rule 13(D)(1).
IT IS, THEREFORE, ORDERED that the Honorable J. Terrence Cody is appointed as special judge to hear this matter in the Clark Circuit Court. This order vests jurisdiction in Judge Cody. Pursuant to Ind.Trial Rule 79(K), an oath of office is not required.
The Clerk of this Court is directed to forward notice of this Order to the Hon. Daniel F. Donahue, Clark Circuit Court, 501 East Court Avenue, Jeffersonville, IN 47130-4029; to the Hon. J. Terrence Cody, Floyd Circuit Court, 311 West First Street, #417, New Albany, IN 47150-5856; and to the Clerk of the Clark Circuit Court.
The Clerk of the Clark Circuit Court is directed to forward notice of this Order to all parties of record in the case below.
