ORDER REMANDING JURISDICTION TO TRIAL COURT

      Comes now the Clerk of the Boone Superior Court, and pursuant to Ind.Trial. Rule 53.1, certifies this matter here for the appointment of a special judge.

      And this Court, being duly advised, now finds that, jurisdiction of this matter should be remanded to the Boone Superior Court and Special Judge Kathy R. Smith, who shall reconsider whether recusal is necessary in light of this Order. The Chronological Case Summary reflects that the petitioner acquiesced in the delay of the ruling for approximately seven years. This Court finds that withdrawal at this stage would disrupt the proceedings and frustrate the purpose of the rule.

      IT IS, THEREFORE, ORDERED that jurisdiction of this matter should be remanded to the Boone Superior Court and Special Judge Kathy R. Smith, who shall reconsider whether recusal is necessary in light of this Order.

      The Clerk of this Court is directed to forward notice of this Order to the Hon. Kathy R. Smith, Clinton Superior Court, 320 Courthouse Square, Frankfort, IN 46041-1963 and to the Clerk of the Boone Superior Court.

      The Clerk of the Boone Superior Court is directed to forward notice of this Order to all parties of record in the case below.
