ORDER CONTINUING APPOINTMENT OF SENIOR JUDGES

Based upon 2002 weighted caseload statistics and in consideration of amendments to Ind. Administrative Rule 5, this Court appointed senior judges to trial courts beginning January 1, 2004 and ending June 30, 2004. Courts wishing to continue the appointment of senior judges for the twelve (12) month period beginning July 1, 2004, and ending on June 30, 2005, must demonstrate a need based on 2003 weighted caseload statistics or other extraordinary circumstance warranting an appointment of senior judges to be used at the discretion of the requesting court subject to service day restrictions based upon weighted caseload. This Court has decided upon service day restrictions after careful consideration of the weighted caseload measurements, the statewide utilization average, and other factors relating to the senior judge program. The following schedule sets out the number of senior judge service days during the present appointing period to which a trial court is entitled:

Less than 1.0 utilization maximum 10 service days Ex. A

Between 1.0 and 1.49 utilization maximum 20 service days Ex. B

Between 1.50 and 2.00 utilization maximum 30 service days Ex. C

More than 2.00 utilization unlimited service days Ex. D

Extraordinary circumstances unlimited service days Ex. D

This Court finds that the senior judge appointments as listed in Exhibits A, B, C and D are appropriate beginning on July 1, 2004 and continuing until June 30, 2005.

IT IS, THEREFORE, ORDERED that the senior judge appointments listed in Exhibits A, B, C and D, attached hereto, are extended through June 30, 2005, and that the senior judges herein appointed may serve up to the maximum allowable service days at the discretion of the requesting judge as permitted by Administrative Rule 5 and other statutory provisions. It shall be the responsibility of the requesting court to ensure that the maximum number of service days permitted is not exceeded. Pursuant to Ind.Code § 33-4-8-5, senior judges appointed by this Court in this order may not be compensated as senior judge for more than one hundred (100) days in the aggregate during this calendar year.

The Clerk of this Court is directed to forward a certified copy of this Order to each of the senior judges listed on Exhibits A, B, C and D; to the clerk of each trial court listed on said exhibits; to the Indiana Judicial Center; and to the Division State Court Administration, Payroll Section.

The clerk of each trial court listed herein is directed to forward notice of this order to the judges listed on Exhibit A, B, C and D of this Order and to place this Order in the Record of Judgments and Orders of each court so listed.
