ORDER APPROVING BOONE COUNTY LOCAL RULE 23
The judges the Circuit and Superior Courts of Boone County, request the approval of Local Rule 23 establishing case assignment rules when the law firm of Kincaid, Taylor, Sims, Chadd & Minette appear in cases in Boone Superior Court 1. This Local Rule is proposed pursuant to an ongoing conflict of interest exists between the presiding judge of Boone Superior Court 1 and an attorney practicing with Kincaid, Taylor, Sims, Chadd & Minette, and establishes a procedure by which cases shall be assigned to the Boone Superior Court 2 and the Boone Circuit Court on a rotating basis following the recusal of the presiding judge of Boone Superior Court 1.
Upon examination of the proposed local rule, this Court finds that the adoption of this local rule is appropriate, and accordingly, should be approved.
IT IS, THEREFORE, ORDERED by this Court that Local Rule 23, set forth as an attachment to this Order, is now approved, effective August 1, 2004.
The Clerk of this Court is directed to forward a copy of this Order to the Honorable Matthew C. Kincaid, Boone Superior Court 1, to the Honorable Steve David, Boone Circuit Court, to the Honorable James R. Detamore, Boone Superior Court 2, and to the Clerk of the Boone Circuit and Superior Courts.
The Clerk of the Boone Circuit and Superior Courts is directed to place a copy of this Order in the Record of Judgments and Orders for all courts of record in the county and to post this Order for public examination.
