ORDER APPROVING LOCAL RULE FOR
The judges of the Delaware Circuit Courts request the approval of an amended local rule of criminal practice involving the assignment of cases pursuant to Criminal Rule 2.2. Attached to this order is the proposed local rule, entered in such courts on August 29, 2003. This rule provides for the random assignment of criminal cases by rotating filings among the five circuit courts, except for re-filing and subsequent filings against the same defendant, which will be assigned to the court handling the initial case.
Upon examination of this local rule, this Court finds that the proposed amended local criminal rule complies with Criminal Rule 2.2 and, accordingly, should be approved.
IT IS, THEREFORE, ORDERED by this Court that the proposed amended local criminal rule, set forth as an attachment to this Order, is now approved, effective August 29, 2003.
The Clerk of this Court is directed to forward a copy of this Order to the judges of the Delaware Circuit Court and to the Clerk of the Delaware Circuit Courts.
The Clerk of the Delaware Circuit Courts is directed to place a copy of this Order in the Record of Judgments and Orders for each circuit court and is further directed to post this Order for public examination.
