ORDER APPROVING JOINT LOCAL RULE 4

The judges of the DeKalb Circuit and Superior Courts, pursuant to Ind.Criminal Rules 2.2 and 13 and Ind.Trial Rule 79, have submitted to this Court for approval Joint Local Rule 4:  Conflicts in DeKalb Circuit Court,  which shall apply to the reassignment of cases and the selection of a senior judge in cases where there is an order of disqualification or recusal entered in DeKalb  Circuit Court based on prior contact of the regular presiding judge or his former law firm.

Upon examination of the local rules, this Court finds that Joint Local Rule 4: Conflicts in DeKalb Circuit Court should be approved as an adequate method of dealing with the continuing recusal situation based upon the judge’s prior law practice.

IT IS, THEREFORE, ORDERED by this Court that Joint Local Rule 4: Conflicts in DeKalb Circuit Court, regarding the method of reassignment of civil and criminal cases following recusal by the regular presiding judge based on his prior law practice, is approved, effective October 6, 2003.  A copy of the local rule is attached and incorporated herein.


The Clerk of this Court is directed to forward a copy of this Order to each of the judges of the DeKalb Circuit and Superior Courts and to the Clerk of the DeKalb Circuit and Superior Courts.

The Clerk of the DeKalb Circuit and Superior Courts is directed to place a copy of this Order in the Record of Judgments and Orders for such courts and post this Order for public examination.
