The Indiana Supreme Court Disciplinary Commission has filed a Verified Complaint for Disciplinary Action against the above-named attorney pursuant to Ind. Admission and Discipline Rule 23, Section 12. On August 12, 2004, pursuant to Section 11(b) of said rule, this Court appointed a successor hearing officer to hear this matter. That hearing officer has now advised this Court that he is unable to preside over this matter. Accordingly, we find that a second successor hearing officer should now be appointed.
IT IS, THEREFORE, ORDERED that the Hon. William J. Boklund, Judge of the LaPorte Superior Court 4, is hereby appointed to hear this matter pursuant to Admis.Disc.R. 23, and is directed to qualify and assume jurisdiction.
IT IS FURTHER ORDERED that the hearing officer has the authority and affirmative duty to manage this case and to bring it to conclusion as expeditiously as practicable.
The Clerk of this Court is directed to send a copy of this Order to the Honorable William J. Boklund, to the Hon. Linley E. Pearson, and to the parties in said cause or their respective attorneys.
